The Firm handles the filing of bankruptcy cases under Chapter 7 and Chapter 13 in Miami-Dade, Broward and Palm Beach counties. If you are receiving harassing phone calls or are being sued in Court or your salary is being garnished, then you may want to have us assist you in considering whether to file Bankruptcy. Many of our clients find themselves in financial trouble for a variety of reasons, and in many situations, through no fault of their own. In any economy, we find that clients have been laid off from work, are divorced or separated from their spouses, or have suffered an illness or injury that results in them no longer being able to afford their monthly financial obligations. With mounting debt and outrageous interest rates being charged by the credit card companies, it is not unusual for it take decades to repay all of this money. Meanwhile, our clients need to continue to pay their regular bills such their mortgage or rent, utilities, and ordinary living expenses. Bankruptcy provides protection against creditor harassment and gives people the opportunity to get a financial “fresh start.” Bankruptcy can stop repossessions, foreclosures, wage and bank garnishments, judgments, lawsuits and IRS levies. Now, more than ever, filing bankruptcy can be a complex process. However, at Militzok & Associates, we have a caring, compassionate, and an experienced staff of attorneys and bankruptcy paralegals to make the process as simple and stress-free as possible. We know that you are going through a difficult time. The hardest part of any financial crunch is taking the first step to free yourself from the financial pressure you are experiencing. Once you fill out the form to the right, we will be happy to explain all of your options in a clear, concise and honest manner, leaving you with all of the information that you need to make the correct decision for yourself.

Chapter 7

Chapter 7 for individuals or married couples may allow you to eliminate most, if not all, of your debts including credit card debt, debts that have been transferred to collection agencies, and debt from unpaid medical bills. One of the primary purposes of Chapter 7 Bankruptcy is to discharge debts to give an honest person a “fresh start.” Even with the changes to the bankruptcy regulations in 2005, the majority of people still qualify to file a Chapter 7.

In order to confirm that you are eligible, we offer a free consultation to determine which bankruptcy chapter is the most appropriate for you. One of the key benefits of filing bankruptcy is the “automatic stay.” The automatic stay requires all of your creditors to immediately stop all collection actions against you. This means that they can no longer harass you by telephone, or send you any additional bills in the mail. In addition, Chapter 7 may assist you in resolving the following issues: lawsuits, bank and wage garnishments, depositions in aid of execution, and license suspension. Additionally, Chapter 7 can offer relief from real estate mortgages and high car payments for properties and vehicles which you no longer wish to retain.

Chapter 13

Chapter 13 for individuals or married couples allows you to make, in many cases, reduced payments on your outstanding bills and set up a repayment plan that you can make over a period of three or five years. Chapter 13 offers some options that are not available in Chapter 7. For example, Chapter 13 offers the opportunity to save your home from foreclosure. A Chapter 13 case can stop foreclosure proceedings and can assist you in bringing your delinquent mortgage payments current by allowing you to pay the delinquent amount over a period of years. In addition, the Court allows you to make payments to your creditors based upon what you can afford, not what you owe. Once you make all of your monthly payments to the Court in your payment plan, whatever amounts remain due after you complete the plan are forgiven or discharged.
