Bank and Debit Card Fraud
Florida is ranked first in the United States for the number of identity theft and fraud complaints per capita. When money is withdrawn from your bank account without your permission or knowledge due to fraud, you may have a claim to recover your money under the Electronic Funds Transfer Act (EFTA). EFTA requires that you promptly notify your bank of the fraud usually within 60 days. Once you file your claim with your bank, they are required to promptly conduct an investigation into the fraud claim and inform you when the investigation is complete. If the bank refuses to conduct an investigation or refuses to return the stolen money to you, you may be entitled to file a claim against the bank under EFTA.
